Federal procurement readiness (2 CFR 200)

When an agency uses FEMA or other federal funds, its debris contract must follow the procurement standards at 2 CFR 200.317–200.327 and include the applicable provisions in 2 CFR 200 Appendix II. Omni Construction is willing to accept the federal contract provisions required in an agency’s solicitation and to sign the related certifications. Nothing here says FEMA or any agency has reviewed or approved Omni Construction.

Appendix II provisions we accept (as applicable to the contract)

ProvisionApplies when (2 CFR 200 / FEMA guide)
Remedies for breach (App. II(A))Contracts above the simplified acquisition threshold (currently $250,000)
Termination for cause and convenience (App. II(B))Contracts above $10,000
Equal Employment Opportunity, 41 CFR 60-1.4(b) (App. II(C))Federally assisted construction contracts
Davis-Bacon and Copeland Anti-Kickback Acts (App. II(D))Only when required by the federal program. FEMA’s guide says the Davis-Bacon clause is not federally required for Public Assistance procurements, but we will comply if a solicitation includes it.
Contract Work Hours and Safety Standards Act (App. II(E))Contracts above $100,000 that employ mechanics or laborers
Clean Air Act and Federal Water Pollution Control Act (App. II(G))Contracts above $150,000
Debarment and suspension, 2 CFR 180 (App. II(H))Covered transactions (FEMA guide: above $25,000); we will certify that we are not excluded.
Byrd Anti-Lobbying Amendment, 31 U.S.C. 1352 (App. II(I))Above $100,000; clause and certification, flowed down to each tier
Procurement of recovered materials / solid waste, 2 CFR 200.323 (App. II(J))Solid Waste Disposal Act §6002; includes managing solid waste in a way that maximizes energy and resource recovery
Prohibited telecommunications and video surveillance equipment, 2 CFR 200.216 (App. II(K))All contracts: no covered equipment or services (Huawei, ZTE, Hytera, Hikvision, Dahua and affiliates)
Domestic preferences, 2 CFR 200.322 (App. II(L))All contracts and purchase orders: preference for U.S.-produced goods and materials where practicable

We also accept the provisions FEMA recommends: changes, access to records, no federal obligation, program fraud and false statements, DHS seal and logo use, and compliance with federal law. The current Appendix II has no separate energy-conservation clause. The rights-to-inventions clause does not apply to Public Assistance. Small-business affirmative steps (2 CFR 200.321) flow down to our subcontracts.

Contract type and T&M

We price debris work as unit-price (per cubic yard, ton, tree or stump) or lump-sum, as the solicitation specifies. Federal rules limit time-and-materials (T&M) work: it is allowed only when no other type is suitable, with a ceiling price the contractor exceeds at its own risk and close agency oversight, and FEMA limits it to a reasonable early period (2 CFR 200.318(j); PAPPG Version 5.0). Cost-plus-percentage-of-cost pricing is prohibited, and we do not offer it.

Bonding requirements

Unless the agency’s own bonding policy applies, contracts above the simplified acquisition threshold require a 5% bid guarantee and 100% performance and payment bonds (2 CFR 200.326). Bonding and insurance information is available on request.

Disclaimer. FEMA and USACE do not endorse contractors. Omni Construction is not endorsed, approved or certified by FEMA, the U.S. Army Corps of Engineers or any federal agency. Eligibility and reimbursement are determined by FEMA for each applicant, and no contractor can guarantee them.
